Reclaiming Mortgage back thats already paid
Is it possible to try to get your mortgage payments returned on a mortgage that has already been paid. Is there anything on this site or others that i can look at?

@Graham Cox I was asking for a certified copy of my mortgage deed then after 2 years they informed me it had been sent to the land registry and they destroyed the paper copy because it was all electronic. In the meantime they took me to court and got a possession order which cost me £47k in their solicitor’s fees!

Solaris sent me an email last week saying that a CCJ had been issued on 4th November and it would be enforced. No paperwork, no mention of it in the numerous emails before and since the 4th November,no due process. Luckily I was online at the time so saw it straight away. 10 minutes later there was another email recalling the CCJ one but luckily I had already forwarded it. Then another email with exactly the same wording apart from all of the CCJ details as in the previous email 🤔🤨 I responded stating that they had not followed due process blah blah blah. The day after another email was sent saying that it was sent by mistake🤣 I said 'too late, the damage has been done now and no mention in the 2nd email just the wording removed so I guess he was hoping I hadn't read the CCJ one🥱 anyway he got all teary eyed and said 'I said sorry🥹' I told him that the distress was off the scale due to mental health problems and the fear of court bailiffs turning up and taking the car and belongings😲he replied with 'that's preposterous and no bailiffs would turn up for a CCJ' I told him 'i watch don't pay we'll take it away so it must be true🤣' then he replied and said 'i told you it was a mistake and I said I'm sorry😭' oh how we can laugh when the shoe's on the other foot😂 anyway I told him I won't take that breach and all the others such as admitting they have no credit card agreement and neither do Barclaycard amongst other breaches especially calling me 'preposterous' knowing about mental health issues so I'll consider an out of court settlement in the next 7days😆 we'll see if he's stopped crying yet and reconsiders their bullying tactics used for almost a year🥱

@Checkmate Attendee 😆😆I've had that before where a private hospital sent me someone else's medical details and they said to destroy it!! I reported it for them too lol.

It only takes a couple of minutes to opt out again. There are 2 options to opt out so I think this may be different. Might be worth doing again to make sure.

@Kay Lakshmi Cruse I was concerned about the online account too. It asked for name, address and NHS number or postcode if you didn’t know it and they already have those details but they need those to know who is opting out. I have previously used the patient access app - before I realised the extent of their deception though I’ve not used that for a few years, so it might have recognised me from that. It’s worth having a look, then decide.
Pra group WIN 🥳
Huge thank you to @Peter Wilson for the help needed to fight these parasites 🙏 Well yesterday was the final hearing on my Barclays debt which pra group bought my personal information. I was lucky to have pra help my case by not adhering to a court order of supplying the deed of assignment they said previously they had They were supposed to send a copy to myself by the 26th nov but nothing turned up They tried to give me a copy just before the hearing which I basically told her to shove it where the sun doesn’t shine. Regret that now as I wish I’d of seen all the bullshit they put together which the judge noticed didn’t even have my name on any of it just an amount and an account number amongst quite a few pages basically telling the judge to join all the dots ! He turned to me and said it looks like you’re going to have an easy afternoon mr sibson which made my day ! Peter had fantastically put together a fee schedule which pra solicitor challenged but the judge added another days rate to it and increased it from £325 to £410 costs, she tried to ask for 28 days to pay which he actually laughed at and said no you have 14 days to pay him so a great win. I held the door for her on the way out and said lovely to meet you which I’m pretty sure she knew I was taking the piss !! Stand up and fight everyone, it’s not an easy ride but you have to do it ! Kind of Win Against DCA as My Claim is Accepted in CC for GDPR Breach
Hi all, I had a hearing last week against a DCA to decide whether my case will be accepted. The DCA solicitor intended to apply for complete strike out my claim as non meritorious and asking for cost of nearly £1000. I contested against them in front of the judge and judge sided with me stating that my claim does have merit for breach of GDPR and rejected there cost. As I filed N1 almost one year ago and that time the knowledge shared here was not as polished as it is now, therefore judge ordered me to file revised particular of claim in 14 days and rejected DCA defence as well and ordered them to file the defence again. I’ll try to send the details to @Peter Wilson and see if he can help in drafting revised POC.
