Update on Lowell Portfolio/Financial claim
Grand rising all, I apologise for the long update, but this is following on from my first day in court on 12th Nov. All I can say is OMG lol. I began feeling scared because it was delayed by hours. Once inside, the District Judge started to say he will be dismissing my case and that it would not be transferred to Chancery, due to it having no merit. He then went onto asking me how Lowell had breached DPA and GDPR and started to side with Lowell and all I could see, was that I would have to appeal. I quoted the necessary CPRs etc and he read it, but then he realised that he had not received my full court bundle and there was problems with their online portal. He then sent us out of court for 15 mins, so he could go and find my bundles. During this time, I started checking notes and using the chatbot to see what points I could raise to get my point across. Once back inside, he was like a changed man, he apologised for the lack of service given by the court and the problems with their system. Then he started skimming my court bundle. He congratulated me on my bundle and said it was very detailed and referred to alot of case law and previous cases relevant to my case. This was then I started to relax, and when I started to connect with him and explain what Lowell had not done and what I was asking for. He then started questioning Lowell's representative (or Agent as she referred to herself as) and she could answer lol. He then asked her why didnt they just send me the deed, She said they didnt have a deed but they had a debt sale agreement, of which she said was sent to me. I confirmed it was not received and that I had only received print outs of my statement with my original debtor and a generic copy of an credit agreement, which did not have my name, date or signature on. He also pointed out that I should be sueing Lowell Financial not Portfolio!!!!! Note to all, because the notice of assignment says Lowell Portfolio, but Lowell Financial were the ones who wrote to me. So he gave me advice in court to say I should have sued Lowell Finance because they are the ones who dont have anything!!!

Cabut Threating Legal Action
At this point I have sent all my SARS, Cease & Desist, Letter Before Claim & NIP and they still keep coming back. Pondering best approach to go to court or try and use the courtless defense process, considering the court corruption these days.

@Peter Wilson - In the courtless defense paperwork it mentions "Captain Alexander Dalrymple Smyth" as the LPOA advocate. Would you suggest coming up with a different name for my own or doesn't it matter?

@Peter Wilson Sorry matey daft question. I was just wondering if they are likely to ask for any kind of ID from the independent financial advocate or anything else for that matter. Also, on the expenditure form can i confirm that if it's not a joint application then it's just my monthly income details?
Higher Court Application - Is It Worth It After Last Nights Bombshell?
I've been to the local magistrates court and after being removed from the stand (I wouldn't say I was the ens legis name) I got the usual letter from the council saying the LO was approved (where's the proof?) Anyway I'm now applying to the Higher Court via the S111 MCA process. After last nights information on higher courts overturning any decision on a whim I'm wondering if its worth the £156 and huge effort to be heard at a higher court? The way Steven was treated really knocked the stuffing out of me. So do I not appeal and just deal with the DCAs or is it worth the fight... ???🫣🫠

From an email i received this week from a man: alan; He does spend the first few sentences apologizing for the delay in telling me lol 🤣 The other reason for sending you this message :peter. is to say thank you very much for all your help so far. You have another success on your hands. 👍😃 On Monday just gone, 3rd February 2025 at Preston County Court, my "Defence" against "TM Legal Services Limited" and "Perch Capital Limited" for an alleged "debt" originating from "a failure to make payments for an AA Credit Card" was successful and the Judge did dismiss the case. Following your Zoom training course on 15th December 2024 (i think), i did squeeze one last SAR to "Perch Capital Limited" and when the (surprisingly quite prompt) reply was received ignoring my request (again) for a copy of the Deed of Assignment i did send the follow-up, which did result with a reply right at the last minute quoting the usual "it contains sensitive information" and refusal to provide a copy of the Deed of Assignment because "we don't need to". i was able to include this information in my bundle of documents. The Judge did seem a decent fella and held that we do require evidence of the Deed of Assignment. They tried citing the original account number as evidence on the balance of probabilities that the assignment had actually taken place. 😂 i also did discuss with the Judge that although the claimant was not obliged to provide the Deed of Assignment under the "Law of Property Act 1925", i am entitled to see a copy of my personal data under "GDPR" contained on that document, the Deed of Assignment. i either forgot about this over the time that has passed, or did not even research this aspect and completely overlooked it until you talked about it on your training event :peter: so i do thank you again.
