How do you reconcile the subjective nature of the RIGHT of freedom from fear and want with the structural apparatus that created it in the first place?
A single mother of three children has different fears and wants than a 80 year old pensioner.
If this structure is not a utopian aspiration and rather a structural framework - how does a man come forward to make the claim in a space and structure that seems to be a vague concept that is nuanced with personal input?
Food, shelter, continuous improvement and development - means different things to everyone..
How can that RIGHT to the freedom be defined in such a vast space ?
The instruments give some direction - but also intentional keep the definition broad.
From that vantage point - the preamble of ICCPR and art. 11 - does strike me as utopian. The open interpretation indicates that there is much more than meets the eye..
Is having an instruments that has utopian aspiration negate the article to uphold?
