Title issues - IS there a fix?
I have a seller in Arizona who owns an 85% undivided interest in two parcels. Two other heirs each own 7.5% and have ignored certified letters for years. The original property was surveyed and split into two parcels after the owner's mother passed away intestate. One parcel has a manufactured home the seller wants to sell immediately, while the other has a cloud on title due to the co-owners. My questions are: 1. If the property was legally split into two separate parcels, do the 7.5% heirs automatically own 7.5% of bothparcels, or could one parcel have clean title? 2. Has anyone successfully closed on a situation like this without obtaining the missing heirs' signatures? 3. Would a title company insure the sale of the seller's 85% interest, or is a partition action typically required first?

From what I’ve seen in Arizona, if the heirs inherited an undivided interest before the property was split, they typically still own that same percentage in both parcels unless a deed, partition agreement, or court order says otherwise. A legal parcel split doesn’t automatically create separate ownership interests. I’ve seen investors close on an 85% interest before, but it’s usually a cash buyer who understands what they’re buying. Most title companies won’t insure marketable title on the entire parcel without addressing the missing heirs, so a partition action or another curative process is often the cleanest path. I’d start by pulling the probate file and vesting deed. That’s usually where the answer is

@Michecarly Osirus okay yea that's definitely a good sign. It sounds like your attorney got some solid guidance from the county, and if the shed issue is the only thing holding up the split, that's a lot better than I expected. The only thing I'd still want to verify is how title vested after probate. The county can approve or recognize a parcel split, but that's separate from who actually owns each parcel.. I hope that ,makes sense. I'd have the title company run vesting on both parcels after the split and confirm whether the other heirs still have an ownership interest in both, or if one parcel ended up vesting solely in your seller. That'll most probably and likelygive you the answer a lot faster than guessing. If title confirms the manufactured home parcel is clean, you're probably in great shape. If not, at least you'll know exactly what needs to be cured before getting too far into escrow. Keep us posted. I'm genuinely interested to hear how title ends up handling this one because it's an interesting scenario and a good learning opportunity for everyon.e
