Title issues - IS there a fix?
I have a seller in Arizona who owns an 85% undivided interest in two parcels. Two other heirs each own 7.5% and have ignored certified letters for years. The original property was surveyed and split into two parcels after the owner's mother passed away intestate. One parcel has a manufactured home the seller wants to sell immediately, while the other has a cloud on title due to the co-owners. My questions are: 1. If the property was legally split into two separate parcels, do the 7.5% heirs automatically own 7.5% of bothparcels, or could one parcel have clean title? 2. Has anyone successfully closed on a situation like this without obtaining the missing heirs' signatures? 3. Would a title company insure the sale of the seller's 85% interest, or is a partition action typically required first?

@Tuu Funaki Spokeo with him, his lawyer said, " I have been talking to the Gila County Assessor about your lot in Strawberry and he said that you can split this property without a new survey, just using the 2010 survey. On the deed it would just need to have a legal description that describes the property as something like "Lot 48 of Strawberry Mobile Haven as shown on the Record of Survey #3837". When that deed gets recorded, the assessor's office will split the property just as it is shown on that survey with the "new lot line". The only problem is that it looks like there is a shed, or a couple of sheds right where that split line will be on the South side of the lot (See attached image). The assessor's office will need confirmation that those sheds have been removed, or that the lot line is either in the middle of those sheds or off to the side of them. If the property line does go through the middle of the sheds or off to the side, it will be fine to split the property that way, but you will have to get a variance from Gila County Zoning to allow for a 0-foot setback on that split line. Do you happen to know where that survey monument is located on the South side of the lot for that old split? If you can get this sorted out with Gila County, then you should be able to sell the property sooner and we won't need to charge you for a survey, just a little bit for the time to do research into the property with the Assessor's office."
