Question - JV agreement with mortgage brokers
I haven’t Mortgage Broker that is bringing me clients and they typically charge their 1% on top of our fee. But we have a multimillion double clothes. He’s bringing to the table and doesn’t want to charge the client, which is his friend one percent on top of our fee and would like to have a referral fee from me instead. And I’m totally fine with that. My question is on the JV agreement, would you specify that the referral fee is only provided if he is not charging his Mortgage Broker fee to the client? And a separate question is how would you do your referral fee with somebody like this? Would you still provide them a referral fee even if they’re charging the client they’re one percent Mortgage Broker fee? If you have a DV agreement with the Mortgage Broker and are open to sharing how you put that document together with me, I greatly appreciate it!

$13k in EMD on a $13,000,000 deal 🤯
Real deal example. Commercial acquisition in Florida. Purchase price: $13 MILLION. 🏢💸 The buyer had everything lined up… except the $130,000 earnest money. So we showed up with it. 💪 💵 Upfront fee: 5% ... collected upfront. 📈 And if it had closed? Another 20% waiting at the closing table! Unfortunately, this one didn't close. 😬 Died in due diligence, and EMD came right back. But the upfront fee paid the cost of capital and operations, so all was good. We need to swing to get a hit. Who's bringing us the next one ... the one that will close? 👀 😉

Chase Bank for Morby Method transactions?
Has anyone been using Chase Bank to support funding Morby Method transactions? I'm having a bit of a scare with Relay bank freezing people's accounts and not returning funds to folks. So, I'm hesitant on using them.... If you're not using Chase bank but use another bank, which has been a good experience for you ?

Morby Method Question: risks of having borrowers on our OA
What are the pros and cons/risks about having a borrower on my entity operating agreement for Morby Method deals if I’m funding them? This would allow me to fund directly into escrow. *note: I wouldn’t sign anything paperwork like a PG. @Paul Brown

@Paul Brown Appreciate the detailed response! I'm really trying to wrap my head around this, so I appreciate the discussion! Yes, I am referring to the OA on my lending entity LLC. Even if this is done with a primary lender that does NOT have seasoning and sourcing requirements, could it still become an issue even if i do not sign anything attached to the transaction? Would I be responsible for the loan in any way? I think the buyer/ borrower would need to be a high % member on the OA for the primary lender to accept down payment funds coming from my LLC entity, but I could be wrong.. thoughts? I've had borrowers even request for me to perform the transaction this way - having them on my OA so I can fund directly into escrow - and I'm trying to understand WHY and the risks involved for us as lender. Seperate conversation that also drew my attention to this concept was because the hesitation of people using Relay bank because they've been freezing many accounts and people cannot get access to their funds. This also scares me also...
