Higher Court Application - Is It Worth It After Last Nights Bombshell?
I've been to the local magistrates court and after being removed from the stand (I wouldn't say I was the ens legis name) I got the usual letter from the council saying the LO was approved (where's the proof?) Anyway I'm now applying to the Higher Court via the S111 MCA process. After last nights information on higher courts overturning any decision on a whim I'm wondering if its worth the £156 and huge effort to be heard at a higher court? The way Steven was treated really knocked the stuffing out of me. So do I not appeal and just deal with the DCAs or is it worth the fight... ???🫣🫠

@Helen Joy I'm new here, so is there no point challenging the liability order with the magistrates ie is there no requirement for a liability order to be signed by a justice of the peace? I've also been told CPR 5.2 says other parties (e.g. council) can make their own documents but when I read the rule it says (1) Where under these Rules, a document is to be prepared by the court, the document may be prepared by the party whose document it is, unless –a) a court officer otherwise directs; or (b) it is a document to which – (i) Revoked (ii) omitted (iii) CCR Order 28, rule 11(1) (issue of warrant of committal), applies. Is this just saying the council can prepare the liability order with all the information or is it saying the council can basically make it's own liability order with all the information and authorisation? Also what should a true liability order have ie signature of a judge? An embossed stamp? And are they even a thing anyway because I'm told that they were done away with in 2003?
Charging order, Civil National Business Centre. Do I need to file n244? Land registry actions?
Hi guys and gals, I received notification last November 2024 from Wilkin Chapman that they were seeking an interim charging order. I wrote to them and also to Civil National Business Centre basically asking for the proof they have that the charging order is valid. CNBC didn't reply, Wilkin Chapman did but just said they were carrying on towards final charging order regardless. Fast forward to September this year Wilkin wrote to me again saying it's been heard in CNBC now for final charging order. I went to magistrates to see the liability order, was told no admin staff available and to visit magistrates next town over who might be able to help and/or council building next door. Went to council building was told all I can do is send an email lol! Sent email to both council and magistrates. I've attached pic of email I sent. Had no reply from council, attached replies from magistrates. Got letter from Land Registry 13th November 'notice to a registered proprietor of the entry of an agreed notice - B132'. Seems charge has been placed at land registry. Question is now how do I remove it please?

@Ali Bee I put alerts on, didn't get email but got letter the b132, is that what you get when you've got alerts on?

@Peter Wilson could you make any suggestions please? Should I file n244 with CNBC perhaps? In meantime do SAR to council and magistrates?
