Can I count this as a win?
I have had a letter from Cabot. They say "Unfortunately, it appears that Lloyds Bank are unable to provide the requested documentation. If at any stage the documents become available, we will forward these to you and the account will become enforceable once more. This means we are not permitted to obtain a county court judgements or a warrant for diligence against you. In addition, I can confirm due to the time elapsed this entry will no longer appear on your credit file. Although your account is currently unenforceable, the balance remains payable and due."

Ever since I had the letter saying the debt in unenforceable Cabot have been ringing me multiple times a day and have stepped up the letters inviting me to pay. What should I do next?

Bristow and Sutor SAR has arrived
We have now received the SAR from Bristow and Sutor, it has lots of enforcement notices and prior to enforcement visit notice. There is a chart listing the debt and case numbers with mention of the liability notice. which my daughter has never seen. what should I be looking for as they have said they have not bought the debt but acting on behalf of the council. all help appreciated.

Ten liability orders date back to 2016. I now have the SAR back from the council, and they have included the summons for the 10 liability orders. Although none of them look like they have come from a magistrates' court, as there is no court stamp on them. I attach one. I have emailed the court to get more information.

I emailed the courts about the liability orders, they have finally got back to me and said we can have a copy of an extract of the court record but I have to pay for it. this is the reply from the court. "The requirement for the court to produce a written liability order was abolished in 2003 and therefore none was produced or signed. The evidence of the order is the extract, which you will receive if you pay the fee. We do advise you to contact the council directly as they may be able to help you further with your query. The Magistrates Court only hold council tax records on the day of the summons hearing."
Cabot
I found this letter in my SAR from Cabot. It's a letter from Lloyds, stating that they have sold the loan to Cabot. However, before this, Westcott had the debt, so surely if they sold it to Westcott, they couldn't sell it again. Reference: Lloyds Bank - Loan Account No. xxxxxxxxxx Wescot reference: xxxxxxxxxxxxxx Pitreavie Business Park Dunfermline KY99 4BS Direct Line: 0808 145 0370 Opening Hours: Monday - Friday 8am-7.30pm Saturday 8am-4pm 4th February 2019 We are writing to notify you that Lloyds Bank has assigned all of its respective rights, title and interest in respect of the above referenced account (including the outstanding balance) to Cabot Financial (UK) Limited part of the Cabot Credit Management Group, effective 25th September 2018. The total balance sold was £4,857.64 as at the date of sale 25th September 2018. Any payments made towards your Lloyds Bank loan account after 25th September 2018 will be forwarded to Cabot Financial (Europe) Limited (part of the Cabot Credit Management Group) and will be deducted from the balance shown above. Under the terms of this assignment, and as defined in the Data Protection Legislation, Cabot Financial (Europe) Limited, is now the Data Controller of your Personal Data contained in the records of this account. Cabot asking for 90 days
I sent my first SAR to Cabot Financial on 13th May 2025. They have written back to me saying they will send the SAR, but I will have to wait until 13th August 2025. Do I have to wait the 3 months, or can I send the second letter after 30 days.

so I have sent 3 sars and the estopple, cabots reply is Thank you for your email on 04 August 2025. We received your Subject Access Request (“SAR”) and the relevant ID documents on 13 May 2025 and subsequently supplied you with your data through our secure portal, Kiteworks on 25 July 2025 within regulatory timeframe. We undertake reasonable searches and have provided you with all information relating to you that you are entitled to. As no new concerns have been raised, our position remains unchanged as confirmed in our previous correspondences. Your comments regarding irrevocable estoppel by acquiescence have no basis in law. We suggest you seek Independent Legal Advice. In response to your objection to the processing of your personal data, we are declining that objection for the below reason. In accordance with Article 6, as mentioned previously, we rely on legitimate interest to process your personal data. We have purchased your account, and we cannot engage with you to collect any outstanding balances without processing your personal data. We believe that the processing would be expected by customers from a transparency perspective, as the original creditor had your personal data in order to manage your account. Additionally, our processing will be in line with our privacy policy that was highlighted to you when we sent you our Notice of Assignment. On balance, we believe that we simply cannot meet that purpose; engage with you to arrange to collect the outstanding balance without processing your personal data, and we believe that our legitimate business need outweighs any potential detriment and will not impact your rights and freedoms. In summary, we believe that our processing of your personal data is lawful, fair and transparent If you are requesting for another SAR; due to the short amount of time elapsed, data is likely to be limited. Dispute final response from link
I have received a reply from Link from 2nd SAR, They have titled it DISPUTE FINAL RESPONSE LETTER. They say they have not breached any guidelines. They acknowledge receipt of my Final notice. Please note we do not accept the content, nor any Freeman of the land style templates. As such we do not consider your claim to be a valid dispute and any further correspondence received containing similar text will be logged and not responded to. I can confirm that we issued your DSAR within regulatory timeframe, and it contained all the information we hold about you and your account. (which was nothing except a list of letters and phone calls.) I can confirm that we have provided everything required to be enclosed within our original DSAR response. I can confirm that this debt is known as "chose in action". As the original lender holds the legal right to collect the debt, they also hold the right to assign their rights to LC Asset 2 S.a.r.t. Although the lenders do not need the customer's permission to do this, Section 136 of the Law of Property Act 1925 requires, in order for there to be a legal assignment, that notice of assignment, should be given in writing which we have complied with. As per the above information, I can confirm that legal assignment has demonstrably taken place, and that we are now the legal servicers of the above account. You remain liable for the outstanding balance. I have checked back in the SAR and there is no notice of assignment, their first contact was a text message. No mention of a notice of assignment.

@Jacqueline Howsen i think Link is a different firm to LC2 because LC2 are not able to collect debt in their name because they are not regulated by FCA and don't have part 4a, so they give it to link. I think thats right but if you watch the video for last weeks meeting Peter talks about this situation.
