This course exposes the true legal hierarchy that governs the Constitution, the Charter of Rights and Freedoms, and every statute enacted in the country.
You will learn how the Canadian legal system presents rights as conditional while quietly relying on a deeper order — the principles of justice found in international human rights law and peremptory norms.
Through precise analysis, case studies, and textual examination, this course shows how Sections 1, 7, 24, 26, and 52 operate together, what they conceal, and how they reveal the actual legal framework Canada is bound to.
You will understand the difference between declaratory rights and executable rights, how jurisdiction is assumed through presumption, and why certain rights cannot be limited under any circumstance.
By the end of the course, you will be able to interpret the Constitution through the correct legal hierarchy, identify when judicial authority collapses, and recognize the rule of law as it truly exists — not as it is taught or performed, but as it functions in principle.
