So a letter was sent to my partners “person” for an alleged debt from 2016 which involved an housing benefit overpayment, they were going to do an attachment of earnings for £150 per month.
As it is the “person” claiming and with the threat of AOE I decided the only way to beat them is using their own legislation against them, as the council likes to ignore letters and as I wanted written responses I decided to use a 3rd party email calling it dispute resolution service, knowing they could not reply to an unauthorised email, using it to notify executives and provide proof the delivery and acceptance of the letters.
The first letter included a SAR which put them on a 30 day compliance deadline.
Note: As there are two parties within the name of the person, and the signor was the agent I wrote the letters as we instead of I… also wrote the name as First Middle [double space] SURNAME showing a separation.
The signing line stated By: authorised agent & representative for ALL CAPS NAME in font size 1 micro print
So once the first letter had been sent to the housing benefit overpayment team, they had an email notification 3 days after accepting the letter, in that letter I cc in 3 executives.
14 days later they received an interim escalation letter, this time addressed to the three executives prompting them to reply to the initial letter and SAR.
We got a response from the team leader of the housing benefit overpayment team, basically answering each point making some admissions and still demanding payment.
The next letter was escalated to the chief executive, this time written as if they are now causing harm and using their admissions against them, the one question that was never answered was what that reference code on the letters was with full disclosure, I believe it has something to do with the treasury bonds as the first number is 9 digits.
The outcome was on the 1st day of the breach of the SAR they sent a letter recorded delivery writing off the debt.
