dispatch Q : Is starting a dispatch company as a non-american and run it from my country possible?
This is a good question considering we have so may people in the community from all around the globe. I had read some restrictions could be coming. Here is the latest info.
It's called Dalilah's Law and happened as a result of young 5 year old dying after being hit by a driver with a CDL who was NOT a legal US citizen. This bill passed the House Transportation & Infrastructure Committee, but to date has NOT moved on to the House of Representatives although it is eligible.
What it means...It would prohibit motor carriers from using dispatch services whose principal place of business is outside the U.S., or the bordering Countries Canada and Mexico, unless they are properly licensed locally. That means dispatchers outside the U.S. could be impacted, depending on how the law is finalized and enforced.
BUT I will say this...There are tons of businesses in the US that are owned by people who are not U.S. citizens. You can form a LLC in plenty of states without citizenship or green card. The key point will be how the Bill is worded concerning where the business is operationally run...if Delilah's Law is passed.
I think it's crazy because we are using the carriers MC & DOT numbers anyway. Online bank accts are available, and the laws are set up to make the government money. You pay fees, and a lawyer to find the loopholes. That's the way the U.S. works.
