David - For the Ai Trinity offer you don't actually need E&O, however it's so cheap that it's probably worth having. I use nextinsurance.com but that's obviously not legal advice. Here's an Ai breakdown of why you might or might not need it. Ai can make mistakes so again not legal advice. The critical question: Are you guaranteeing a business outcome… or selling a tool/system? E&O insurance is designed to protect you if you give professional advice or perform services that could financially harm the client if done incorrectly. AI chatbots by themselves rarely trigger that requirement. But as soon as your offer crosses into “we’ll manage your pipeline,” “we qualify your leads,” or “your revenue depends on our automation,” you’re functionally acting like a contractor inside their business—and that’s where E&O comes into play. Breakdown: When you don’t need E&O If your offer is built like: - “We provide the software.” - “We install a chatbot widget.” - “We configure AI replies.” - “We give you templates.” - “Here is the system—YOU own the results.” This is classified as SaaS provisioning, not professional liability. Most AI automation affiliates, HighLevel SaaS resellers, and bot builders operate here. No E&O required. (It can help, but it's not required.) When you do need E&O You need to consider it if: - You are managing their leads - You’re responsible for qualifying revenue-producing calls - You guarantee booking rates, revenue outcomes, or ROI - You act as a fractional marketing ops or fractional sales team - You handle critical data and promise compliance (HIPAA, legal, etc.) If your bot says or does something wrong that costs the client money, they can argue you’re liable. This is where E&O protects you. Where a lot of AI agencies accidentally expose themselves Most new AI agency owners unintentionally drift into these high-liability zones: - Writing custom sales scripts for the client - Handling inbound leads and forwarding them - Making appointment-setting guarantees - Taking over support chat - “Done-for-you” workflows tied to revenue or legal compliance - Doing anything that could be construed as “professional advice”
