The "Allocation of Traffic" Problem
Hi, wishing everybody a great day. Im absolutely new to this business, and before jumping in I'm doing some extra research and Google ai mentioned this issue in 2026 .. and I'll copy and paste it so I don't mess the text. What do you guys think about this? and how to deal with this. The "Allocation of Traffic" Problem The most common legal trap for independent dispatchers representing multiple carriers is "allocation of traffic". - The Conflict: If you see one high-paying load and you have two different carriers available, you must use "discretion" to decide who gets it. - The Legal Trap: In 2026, the FMCSA views this act of choosing between carriers as a brokerage function. If you exercise discretion over which carrier gets a load, you are legally a broker and must have a $75,000 bond.
