Think your VAs, setters, freelancers, etc. are independent contractors?
Surely, they're not employees, right? Maybe. If you get the employee vs. independent contractor analysis wrong, the consequences can be significant—from unpaid payroll taxes to wage claims and other potential liabilities. This week in CounselLab, I'm walking through a hypothetical involving a Skool community owner who hires freelancers to help scale their business (Post 1, and Post 2 are already published). We'll cover: - What factors determine whether someone is an employee or an independent contractor (and why the answer often depends on where the worker is located). - How the analysis changes based on the type of work being performed. - The potential exposure if a worker has been misclassified. - Practical ways to structure your business relationships to help reduce the risk. Here’s the hypothetical Skool community and the setup: A coach teaching a Skool community to grow their membership hires three people: - A virtual assistant - A video editor - A marketing specialist Independent contractor or employees? Sneak Peek: just because someone signs an independent contractor agreement doesn't automatically make them an independent contractor. The legal analysis depends on the facts—not just the contract.

@Courtney Byrnes that’s a great idea. I’ve been toying with the idea of doing walkthrough videos of terms and conditions that business owners commonly agree to (eg. google, facebook, amazon, YouTube, TikTok, Shopify, etc). If that sounds helpful, glad to do it

Hi, I'm Eric I'm a husband and a dad to three boys (10, 12, 17). Professionally, I'm an attorney. I've been in-house/general counsel at global, publicly traded businesses for 13+ years. On the side, I've always advised startups, SMBs, and scaling businesses. My hobbies are split 50/50 between very active (biking, running, skiing) and still (reading and writing). Something surprising about me? We had our first son right in the middle of law school (I don't recommend that timing, but in hindsight, I am very grateful for it).

What if your legal costs dropped as your group grew?
I'm exploring a new model for my flat-fee general counsel service (CounselLab) and would love some feedback. The idea is simple: instead of one business paying for ongoing legal counsel on its own, a group of similar businesses would share the cost. As the group grows, each member's monthly cost goes down. The goal is to bring together businesses that tend to face similar legal issues, so everyone benefits from ongoing access to experienced legal counsel while making it much more affordable. Some examples of groups could include: - Coaches & Consultants - AI Consultants & AI Agencies - SaaS Founders - Content Creators & Influencers - Marketing Agencies - Course Creators - E-commerce Brands I'm curious—which type of group would you be most interested in joining?
