As much as people hate doing MBEs, you have to think of them as mini essays. I noticed that writing out every MBE I got incorrect helped me remember my issues more, so I wouldn't make the same mistakes twice. It is definitely a long process, but as a visual learner, it helped me process where I was going wrong and why.
OK, who is daring enough to take a shot at explaining the differences between the common law standard of material breach or substantial performance versus the UCC Article 2 concept of perfect tender. Go!
@Christian Sotomayor I love this explanation! I've learned that when doing MBE questions regarding the UCC and non-conforming goods, you could eliminate answers using "material breach language or substantial performance." The language is perfect tender. Not necessary that the breach be material at all.
