Today I had the opportunity to present on a lawyers panel for a women in construction conference. @Peter Le and @thalia alvarez joined me! I was the only non-construction lawyer on the panel. Very complex transactions and legal issues are involved.. What an interesting industry! Have you ever consider practicing in that area?

Bar Results & Scoring
To the February bar takers that passed the exam, congratulations! Everyone in this community knows the work dedication. It took to get that result. To the February bar takers that did not pass the exam, I am so sorry. I know how hard you worked and hoped for different results. Allow yourself to feel whatever you need to feel and then immediately develop a plan of how you’re gonna get past the next exam. To help, Belyn is currently uploading all past CA bar essays in our classroom! I’ll make sure to do weekly MBE practice here too! I would like to mention one thing. I overheard a lot of people talking about getting 65 on an essay. Although that is not a bad score on an essay, I want you all to realize it’s also not a passing score. If you’re averaging 65 that will not get you the scaled written score that you need to pass the exam. Generally, you need a 67% average to get to the current 1390 cut score of the California bar exam. So that means you need to target an average score of 70 not 65 to ensure you pass.. If anybody has questions or needs me to do a webinar explaining our scores and how it works, and how it’s calculated, at least here in California, lmk! #wedonttrywedo #barpassers
Torts Practice
What areas of torts do we need to focus on right now? I will pull a few MC to practice with you all this week! For now, here is a products liability question since it is a torts/contracts cross-over area (in other words it is a torts question but contract principles will help you solve it): The manufacturer made a product that was sold over the counter for treatment of dandruff and dry scalp conditions. A doctor purchases a bottle at a drugstore. A statement on the label read, "This product will not harm normal scalp or hair." The doctor used the product as directed. Bcause of a rare scalp condition making him allergic to one of the ingredients, the product irritated his scalp causeing him much pain and discomfort. In an action for negligence by the doctor against the manufacturer, which of the following additional facts or inferences, if it was the only one true. would be most effective in the manufacturer's defense?

Strong work everyone! If the risk to injury to the doctor was not foreseeable, the the manufacturer could not be said to have acted unreasonably in the face of a foreseeable risk. Since negligence is usually defined as failure to act reasonably in the face of a foreseeable risk, this would mean that the manufacturer was not negligent.
