Open LLC with a foreign company as member
Hi everyone. I'm thinking on opening a single member LLC (disregarded), but the member would be my local company (which I'm the single owner also). Are there any changes in the way 5472 form is filled for this scenario? Also, would it be more difficult to get bank accounts for the company? Thanks.

Hi Luis! So if you own 100% of your local company, which owns the US LLC that makes the US LLC foreign-owned, and you’d file Form 5472 to report those transactions. As for banks, it’s usually the same process.

Having an ITIN doesn’t automatically mean you need to file a US tax return. If you’re a non-resident with a US brokerage account, your broker usually withholds taxes on dividends or gains, which often covers you. You’d only file Form 1040NR if the withholding was wrong or if you want to claim a treaty benefit.

Tax Filing Extension for Non-US Resident
Hi, I need to get an ITIN to be able to file taxes for my Single Member LLC and I just learned it takes a good chunk of time to get it. Is there a Form 4868 alternative for Non-US Residents?

Hi @Javier Lomelin You don’t need an ITIN to file your company’s taxes, just submit Forms 5472 and 1120. If you’re filing a personal return, you can request a Form 4868 extension without an ITIN. Then file your 1040-NR by mail with Form W-7 and your certified ID; the ITIN process may take several months 🫤

In Form 1040-NR, could the home address be rented US Residential Address, instead of Foreign Residential Address listed in W7?

Hi @Sable Rivers Yes, you can use a valid U.S. rented address as your mailing address, even if your W-7 listed a foreign address.
