A Question for the Group from Timm
I have a question regarding the Vienna Convention on the Law of Treaties. "Article 53 renders void any law contrary to peremptory norms." But Article 53 refers to treaties between states and not domestic laws. "This means that if any agreement, policy, or law contradicts a jus cogens norm, it is null and void from the beginning." Is this technically correct? Of course, the ICCPR is a treaty between states, and Article 4.(2) may be covering what Article 53 of the Vienna Convention is talking about... some clarity would be great :)

@Lance Tycholaz Thank you very much. What is the origin of jus cogens, do you have an idea? I mean, for the UN to recognize it and make it binding on all state parties, someone must have given the UN a "nudge" to do that. Why would the UN recognize it on their own with their questionable history? Maybe I have this question because I am still in the process of waking up and recognizing, but to me there must be some ultimate source, someone who said to the UN "hey, you guys need to do this." I'm sure that'll be the next question that my neighbour will ask me :)

@Lance Tycholaz Sounds like a plan. I will try my best to be there, but also have family commitments. Based on what I could find out, the concept of peremptory norms goes back to philosophers in the 18th century and concepts of natural law, based on fundamental values of the international community. It appears that the founding of the UN was based on the aftermath of WW2 and the need to prevent such global conflicts, and promote peace instead. There are, of course, allegations out there that the purpose of the UN was to create a one world government (new world order), etc. However, I am wondering if those allegations have been put out there by bad actors on purpose in an attempt to discredit and smear the good intentions behind the UN. After all, if it was purely evil then it would have never shown interest in the VC, the covenants and in establishing an International Court of Justice. It does seem that there is more good than evil out there, even in those institutions. Ultimately, even an internet search states that peremptory norms "emanate from the 'universal juridical conscience' and the fundamental values of the international community of States as a whole." That "juridical conscience" is an interesting description, because part of the recognition process if to recognize one's conscience and its power. Where does that conscience come from and what is it connected to? That I yet have to find out :)
