GOOD NEWS re:H1B Application Fees
🔥 Breaking: The $100,000 H1B application fee does NOT apply to students already in the U.S.! 🔥 Here’s the official statement straight from USCIS: “The Proclamation applies to new H-1B petitions filed at or after 12:01 a.m. eastern daylight time on September 21, 2025, on behalf of beneficiaries who are outside the United States and do not have a valid H-1B visa.” “The Proclamation also applies if a petition filed at or after 12:01 a.m. eastern daylight time on September 21, 2025, requests consular notification, port of entry notification, or pre-flight inspection for an alien in the United States.” In plain English: 🕛 If you file a new H-1B on or after Sept 21, 2025 (12:01 a.m. EDT) — 🌎 And your beneficiary is outside the U.S. or your petition requests consular notification — ➡️ This new rule applies to you. Here’s what you need to know: 1️⃣ Location matters — Outside-U.S. cases are directly targeted. 2️⃣ Petition type matters — Consular or port-of-entry requests are included. ✅ If you’re already in the U.S. with a valid H-1B, you’re likely unaffected. 🚫 But if you’re outside the U.S., your timeline, strategy, or even eligibility could shift. This is why staying ahead of immigration changes is non-negotiable.
