I have run into an issue with a claim. the roof has 2 layers and State Farm has approved replacing a few shingles. What codes or documents can I use?

Guide for Handling a Roofing Claim Involving Repairs on a Two-Layer Asphalt Shingle Roof When a roof has two layers of asphalt shingles, the issue should not be framed as “two layers are automatically illegal.” That is usually the wrong argument and can weaken the contractor’s position. The better approach is to work through the situation in order: 1. Are repairs required to be code compliant? 2. Does the code prohibit repair or installation over one existing layer? 3. Is the existing roof suitable to receive a repair? 4. Can the proposed repair comply with manufacturer installation instructions? 5. Can the damaged shingles actually be repaired without causing additional damage? 6. What is the appropriate repair scope based on the findings? This guide walks through that framework. 1. Start With the Correct Code Position Repairs must be code compliant. That is the starting point. Any proposed roof repair must comply with the adopted building code, local amendments, and applicable manufacturer installation instructions. However, the existence of a second layer of asphalt shingles is not automatically a code violation. The 2021 IRC allows roof recovering under certain conditions. Installing asphalt shingles over one existing layer is not categorically prohibited. In other words, a roof with two total layers may be permissible if the original recover was properly performed and if the roof assembly meets the applicable requirements. So the argument should not be: “This roof has two layers, so the whole roof has to be replaced.” That is too broad. The better argument is: “Although a second layer is not automatically prohibited by code, any repair on this roof must still be code compliant, manufacturer compliant, and physically repairable. Based on the roof’s actual condition and the repairability assessment, a limited repair cannot be properly completed.” That keeps the argument accurate. 2. Understand What the Code Allows and Prohibits The 2021 IRC does not prohibit installing or repairing asphalt shingles over one existing layer of asphalt shingles.
