Dr. Weir, I am following this as I am in the same situation with my SSDI benefits being withheld due to alleged overpayments. I also believe based on my records and my understanding of the POMS that my income was wrongly calculated beginning with my TWP. This has been going on since 2017, literally, and I have yet to be given documentation from SSA on how they calculated my monthly income. I filed reconsideration, waiver, and also had a scheduled hearing with the ALJ. The ALJ remanded my case back to the field office as she stated it appeared income calculations were incorrect. To date, no resolution and my benefits continue to be withheld. I'm emotionally worn-out fighting for an answer. My questions: - If I agree to a payment plan so I can get SSDI benefits even at a reduced amount, does that mean I'm agreeing I was overpaid? - At my last SSA appointment, I expressed I wanted to file again for an ALJ to review my case and make a decision. I have all my documentation since 2017 disputing this. I was told I had to file a reconsideration and then a waiver all over again. Is this true? Please advise. Kind Regards, Kim McKeon
