Four years ago, I had a personal experience that demonstrated the importance of written agreements in real estate transactions. I listed my property for sale at $XYZ on Facebook and after seeing my ad, a friend who was involved in real estate expressed interest in assisting with the marketing and sale of the property. To ensure that both parties were protected, we entered into a formal written agreement. The document clearly outlined the details of the property being offered for sale, including a description of the property, its location, photographs, and a copy of the land title. Having these details documented created transparency and helped establish exactly what was being marketed to potential buyers. The agreement also served to protect the real estate agent’s interests. It recognized the time, effort, and financial resources invested into marketing the property, such as advertising expenses, placing signage, networking, and sourcing potential buyers. Most importantly, it established the agreed commission structure, ensuring that the agent would be fairly compensated for successfully facilitating the transaction. At the same time, the agreement protected my interests as the property owner. I was not happy with the first agreement and was able to include amendments and conditions that clearly stated the amount I expected to receive from the sale, the designated bank account for payment, and the duration of the listing agreement before I retained the right to withdraw the property from the market. This experience helped me understand that written agreements are essential in real estate because they create accountability, reduce the risk of misunderstandings, and provide legal and professional protection for all parties involved. They clearly define responsibilities, expectations, financial terms, and timelines, which contributes to a smoother and more trustworthy transaction process. The agreement protected us legally because it created a formal written record of the terms and responsibilities agreed upon by each party. I had to wait 6 months before withdrawing my property from their listing and I did not pay any extra fees.
