One thing I've learned during my career as a solicitor is this:
๐ Most legal disputes don't begin in court....
They begin with one small mistake that could have been avoided.
Whether it's a consumer dispute, employment issue, family matter or business disagreement, the same problems appear time and time again.
Here are five of the most common...
๐จ 1. Waiting Too Long
People often hope a problem will simply disappear. Unfortunately, it usually doesn't.
Whether it's:
๐ replying to a Letter Before Action
โ๏ธ responding to court proceedings
๐ท challenging a refund refusal
๐ reporting disrepair
โณ time matters.
Many legal claims have strict limitation periods, and missing a deadline can sometimes mean losing your right to bring a claim altogether.
๐ก The earlier you understand your position, the more options you usually have.
๐ 2. Signing Something Without Reading It Properly
It sounds obvious...yet this is one of the biggest causes of disputes.
People often sign:
๐ฑ mobile phone agreements
๐ tenancy agreements
๐ผ employment contracts
๐ finance agreements
๐ค business contracts
...without reading the small print....though as a consumer you do usually get an automatic cooling off period to cancel for any reason - as long as it was a "distance" sale, so you ordered online or by telephone. This does not apply to tenancy agreements in the UK just to note. Nor business-to-business contracts unless the terms and conditions have one.
Once you've signed, it can be much harder to argue that you didn't understand what you agreed to.
Always ask questions if something doesn't make sense.
๐ฌ 3. Putting Everything in Phone Calls
Verbal conversations are useful...but they're much harder to prove.
Whenever something important is agreed:
๐ง confirm it by email
๐ keep copies of messages
๐ธ retain photographs and screenshots
๐ keep documents organised
A simple email saying: "Further to our conversation today..."
can become incredibly valuable evidence later on.
๐ฑ 4. Posting Too Much on Social Media
Social media has become one of the biggest sources of legal disputes.
Posts, comments and messages can sometimes be used as evidence in:
โ๏ธ employment disputes
๐ family proceedings
๐ผ business disagreements
๐ defamation claims
Even deleted posts may still exist through screenshots.
Before posting, ask yourself:
๐ Would I be comfortable explaining this to a judge?
If the answer is no...don't post it.
โ ๏ธ 5. Assuming You're Automatically Right
This may be the biggest misconception of all.
Many people believe: "I'm right, so I'll win."
Unfortunately, legal disputes don't work like that.....
Courts and tribunals look at:
๐ evidence
๐ contracts
๐ฉ correspondence
๐
timelines
๐ฅ witness evidence
โ๏ธ and the applicable law.
Being right on principle is important. Being able to prove your case is even more important....
๐ก Bonus Tip
Many disputes can be resolved long before court becomes necessary.
A well-written complaint...
A properly drafted Letter Before Action...
Or simply understanding the correct legal process...
Can often save months of stress and thousands of pounds in legal costs.
