TCPA SMS laws in reactivation

I saw that in the solar reactivation breakdown Austin sent an initial message saying "Good afternoon, is this [Name]?" and in the dentist dentist reactivation video a promotional message

How is it legal to send promotional texts and not ending with "Reply "STOP" to opt out" in these campaigns?

I'm looking to start a reactivation campaign but this is the main thing tripping me up right now. ChatGPT & Grok are saying its illegal and could cause a $50,000 fine to send those messages without written consent (which I'm assuming most local businesses haven't gotten, correct me if I'm wrong)

Can anyone clear this up for me?
